Gay marriage backers: NY vote has national impact

Many obstacles still lie ahead for supporters of same-sex marriage, and eventually they will need Congress or the Supreme Court to embrace their goal. For the moment, though, they are jubilantly channeling the lyrics of "New York, New York."
"Now that we've made it here, we'll make it everywhere," said prominent activist Evan Wolfson, who took up the cause of marriage equality as a law student three decades ago.
With a historic vote by its Legislature late Friday, New York became the sixth -- and by far the most populous -- state to legalize same-sex marriage since Massachusetts led the way, under court order, in 2004.
With the new law, which takes effect after 30 days, the number of Americans in same-sex marriage states more than doubles. New York's population of 19 million surpasses the combined total of Massachusetts, Connecticut, Vermont, New Hampshire and Iowa, plus the District of Columbia.
The outcome -- a product of intensive lobbying by Democratic Gov. Andrew Cuomo -- will have nationwide repercussions. Activists hope the New York vote will help convince judges and politicians across the country, including a hesitant President Barack Obama, that support of same-sex marriage is now a mainstream viewpoint and a winning political stance.
"New York sends the message that marriage equality across the country is a question of 'when,' not 'if,'" said Fred Sainz, a vice president of the Human Rights Campaign.
Wolfson, president of the advocacy group Freedom to Marry, said the goal is attainable by 2020, or sooner, "if we do the work and keep making the case."
The work -- as envisioned by leading activists -- is a three-pronged strategy unfolding at the state level, in dealings with Congress and the Obama administration, and in the courts where several challenges to the federal ban on gay marriage are pending.
"This will be a big boost to our efforts nationally," said Richard Socarides, a former Clinton White House adviser on gay rights. "It will help in the pending court cases to show that more states are adopting same-sex marriage, and it will help in the court of public opinion."
The New York bill cleared the Republican-controlled Senate by a 33-29 margin, thanks to crucial support from four GOP senators who joined all but one Democrat in voting yes. The Democratic-led Assembly, which previously approved the bill, passed the Senate's stronger religious exemptions in the measure, and Cuomo swiftly signed it into law.
Gay rights activists have been heaping praise on Cuomo for leading the push for the bill, seizing on an issue that many politicians of both parties have skirted. Yet the Senate vote marked the first time a Republican-controlled legislative chamber in any state has supported same-sex marriage, and several prominent Republican donors contributed to the lobbying campaign on behalf of the bill.
For those engaged in the marriage debate nationally, recent months have been a political rollercoaster.
Bills to legalize same-sex marriage failed in Maryland and Rhode Island despite gay rights activists' high hopes. However, Illinois, Hawaii and Delaware approved civil unions, joining five other states -- California, Nevada, New Jersey, Oregon and Washington -- that provide gay couples with extensive marriage-like rights.
Adding those eight states to the six that allow gay marriage, more than 35 percent of Americans now live in states where gay couples can effectively attain the rights and responsibilities of marriage. Just 11 years ago, no states offered such rights.
For now, gay couples cannot get married in 44 states, and 30 of them have taken the extra step of passing constitutional amendments banning gay marriage. Minnesota's Republican-controlled Legislature has placed such an amendment on the 2012 ballot.
Brian Brown, president of the conservative National Organization for Marriage, vowed to seek defeat of the New York Republicans who helped the marriage bill pass. He also predicted victory for the amendment to ban gay marriage next year in Minnesota, and said this would belie the claims that the same-sex marriage campaign would inevitably prevail nationwide.
"We've won every free, fair vote of the people," Brown said Saturday. "Backroom deals in Albany are not an indication of what people in this country think about marriage."
Efforts may surface in some states to repeal the existing marriage bans, but the prospect of dismantling all of them on a state-by-state basis is dim. In Mississippi, for example, a ban won support of 86 percent of the voters in 2004.
Thus, looking long term, gay marriage advocates see nationwide victory coming in one of two ways -- either congressional legislation or a U.S. Supreme Court ruling that would require all states to recognize same-sex marriages.
"The way you do that is creating a critical mass of states and a critical mass of public opinion -- some combination that will encourage Congress and the Supreme Court," Wolfson said. "By winning New York, we add tremendous energy to the national conversation that grows the majority."
Shorter term, gay rights activists and their allies in Congress would like to repeal the 1996 Defense of Marriage Act, which denies federal recognition to same-sex marriages. The act is being challenged in several court cases, and Obama ordered his administration in February to stop defending the law on the grounds it is unconstitutional.
Democrats in Congress have introduced a bill to repeal the law, while the Republican leadership in the House has pledged to defend it.
Obama, when elected, said he supported broadening rights for gay couples but opposed legalizing same-sex marriage. More recently, he has said his position is "evolving," and he asked gay activists at a New York City fundraiser Thursday for patience.
Nonetheless, frustrations are mounting. Freedom to Marry says more than 112,000 people have signed its "Say I Do" appeal to the president, and gay marriage supporters have launched an EvolveAlready campaign on Twitter.
"We hope that, through this public pressure, we'll be able to move the president to understand that he's falling behind the majority of Americans who see marriage equality as a key civil right," said Robin McGehee of the advocacy group GetEqual.
Several recent opinion polls -- by Gallup and The Associated Press, among others -- have shown that a majority of Americans now approve of same-sex marriage, which a decade ago lagged below 40 percent support. Particularly strong backing for gay marriage among young people, who've grown up watching gay friendly films and TV programs, has prompted many analysts across the political spectrum to suggest the trend is irreversible.
Some conservatives, however, say the opinion polls are belied in the voting booth and point to the steady stream of approvals of state-level bans on same-sex marriage.
"The opposition has created an illusion of momentum but not a real base of support or track record of victory in the courts," said Brian Raum, senior counsel with the conservative Alliance Defense Fund.
Mary Bonauto would disagree.
An attorney with Boston-based Gay and Lesbian Advocates and Defenders, she has spent two decades battling for legal recognition of same-sex relationships. She helped win the landmark court rulings that led to civil unions in Vermont in 2000 and same-sex marriage in Massachusetts in 2004.
Even in the 1990s, she recalled thinking the cause eventually would prevail nationwide.
"I could see attitudes change," she said. "Eventually we have to have one standard of justice in this country and establish that sexual orientation is not a basis for discrimination."
She recalled setbacks just a few years ago in New York -- a 2006 Court of Appeals ruling that there was no constitutional right to same-sex marriage in the state, and the decisive defeat of a same-sex marriage bill in the state Senate in 2009.
"The switch this time tells us there's a lot of momentum pointing toward marriage equality," Bonauto said.
Vermont lawyer Beth Robinson, now counsel for Gov. Peter Shumlin, worked with Bonauto in the late 1990s on the case that led to the state's pioneering civil union law. She expects the move toward nationwide same-sex marriage will be bumpy but inexorable.
"As people get to know their gay and lesbian neighbors, friends and family, the notion of denying those families equal rights becomes untenable," she said. "For New York to go there, on a vote rather that a court order, is huge ... It's a victory not just for New York, but for the whole country."
Robinson said Vermont, which legalized same-sex marriage in 2009, offered a lesson to wary Americans in other states.
"It isn't that the sky isn't falling -- it's more positive than that," she said. "Vermont is a better place for it. Each of us has the opportunity to be our best selves."
Among the New Yorkers who will now get that opportunity are Richard Dorr, 84, and John Mace, 91, who have been partners for 61 years while pursuing successful careers as voice teachers in Manhattan.
"We thought about getting married in Massachusetts, but it just didn't seem to jibe right," said Dorr. "It should be in the state where you live."
They plan to seek a marriage license as swiftly as possible but don't envision a lavish ceremony.
"Just a couple of witnesses and a justice of the peace," Dorr said.
When they fell in love, back in 1950, "marriage never crossed our mind," he added. "It was just that we had to be together. We could not stay away."

Indian Domestic Violence Act - A Brief Overview
Domestic violence also known as domestic abuse, spousal abuse or intimate partner violence(IPV),can be broadly defined as a pattern of abusive behavior by one or both partners in an intimate relationship such as marriage, dating, family, friends or cohabitation.
In simple words it is, "violence between inmates living together or who has previously co-habited."
The main causes of this kind of violence are personality disorders, low -self esteem, lack of assertiveness, stress, violent atmosphere during childhood, dependency etc.
Some of the methods by which females get abused are:

PROTECTION OF WOMEN FROM DOMESTIC VIOLENCE ACT,2005
The Protection of Women from Domestic Violence Act 2005 was brought into force by the Indian Government from October 26, 2006. The Act was passed by the parliament in August, 2005 and assented to by the President of India on 13th September,2005. As on November,2005 it has been ratified by four out of twenty eight state-government in India. Namely Andhra Pradesh, Tamil Nadu, Orissa and Uttar Pradesh.
Of about 8,000 criminal cases registered all over India under this Act, Rajasthan had 3440 cases, Kerela had 1028, while Punjab had 172 cases registered.
HISTORICAL BACKGROUND
The passing of Domestic Violence Act is an important marker in the history of the women movement in India. Prior to this Act, domestic violence survivors were hampered by reluctance to enforce domestic violence as a criminal offence. Although criminal proceedings and injunctions were available under the Indian Penal Code and existing legislation, domestic violence was regarded as a private family matter and police and courts were generally unwilling to take action against the offenders.
OBJECTIVE OF THE ACT
This law has been primarily enacted to provide protection to the wife or female live-in partners from violence at the hands of husband or male live in partners or his relatives, the law also extends protection to women who are sisters, widows or mothers.
The Sailent features of this Act are:
- The Act seeks to protect women who are or have been in relationship with the abuser where both parties have lived together in a shared household and are related by consanguinity, marriage or relationship in the nature of marriage or adoption: in addition relationship with family members living together as a joint family are also included.
- Domestic violence includes actual abuse or threat of abuse that is physical, sexual, verbal,emotional and economic. - One of the most important feature of the Act is woman's right to secure housing.
- The other important relief under the Act is the power of the court to pass protection orders that prevent abusers from aiding or committing an act of domestic violence.
- The draft Act provides for appointment of protection officers.
The Act defines domestic abuse as physical, sexual, emotional, verbal, psychological and economic abuse and threats of the same.
PRIMARY BENEFICIARIES OF THE ACT
Women and children are the primary beneficiaries under the Act. The provision for protection of women is given under section 2(a) of the Act. It will help any woman who is or has been in a domestic relationship with the respondent. This section empowers the woman to file a case against a person with whom she is having a domestic relationship in a shared household, and who has subjected her to domestic violence.
Children too can file a case against parent or parents who are torturing and tormenting them.
WHO ARE THE REAL VICTIMS
The real victims of domestic violence are the rural women who are illiterate and who are hardly aware of their rights. The Act should be implemented effectively in the rural areas

Under this Act, a woman can lodge a complaint even of past co-habitation. This gives her ample opportunity to take revenge on her husband, incase he is innocent. Even the male children are excluded form the purview of the Act.
This Act is a gender-biased Act.
Basically the Act is misused by qualified educated woman who are well aware of the rights conferred by the Act. These women file cases with false allegations against the male person and his relatives and till the respondent's innocence is proved, she gains a lot financially.

Report: Bin Laden courier's phone provides leads (AP)
WASHINGTON ? A cellphone of Osama bin Laden's trusted courier recovered in the U.S. raid last month that killed both men in Pakistan contained contacts to a militant group that is a longtime asset of Pakistan's intelligence agency, The New York Times reported late Thursday.
In a story posted on the Times website, senior American officials and others briefed on the findings said the discovery indicates bin Laden used the group, Harakat-ul-Mujahedeen, as part of his support network inside Pakistan.
It raises questions about whether the group and others helped shelter and support the al-Qaida leader on behalf of Pakistan's spy agency.
The officials and analysts told the Times that Pakistan's intelligence agency had mentored Harakat and allowed it to operate in Pakistan for at least 20 years.
In tracing the calls on the cellphone, U.S. analysts have determined that Harakat commanders had called Pakistani intelligence officials, the senior American officials said. One said they had met. The officials added that the contacts were not necessarily about bin Laden and that there was no "smoking gun" showing that Pakistan's spy agency had protected bin Laden.
Beyond providing leads about why bin Laden was able to live comfortably for years in Abbottabad, a town dominated by the Pakistani military just 35 miles from the capital city of Islamabad, the discovery also may help shed light on bin Laden's secret odyssey after he slipped away from U.S. forces in the Tora Bora region of Afghanistan nearly 10 years ago.
Harakat has especially deep roots in the area around Abbottabad, analysts familiar with the group told the Times. Its leaders have strong ties with both al-Qaida and Pakistani intelligence, known as Inter-Services Intelligence.
The senior American officials did not identify the commanders whose numbers were in the courier's cellphone but said the militants were in South Waziristan, where al-Qaida and other groups had been based for years. Harakat's network would have allowed bin Laden to pass on messages and money to Qaida members there and in other parts of Pakistan's tribal areas, analysts and officials said.
Bin Laden and his courier, Ibrahim Saeed Ahmed, was discovered by U.S. intelligence through a chance interception of an Ahmed phone call. That set in motion the secret CIA search of the Abbottabad region, culminating with the May 2 raid by Navy SEALs that killed bin Laden, Ahmed's brother Abrar and two other people.

BOSTON ? It has all the hallmarks of a Greek tragedy: two brothers whose lives diverge radically ? one into an underworld of crime, the other into the upper echelons of state politics ? yet whose fates remain inextricably linked.
Generations of Boston residents have watched that story play out in the real-life drama of former Democratic Senate President William "Billy" Bulger and his older brother, alleged gangster James "Whitey" Bulger.
At the heart of the story, at least for the younger Bulger, was a fierce loyalty to family and the shared experience of growing up in the working class Irish-American enclave of South Boston, where the line between brawling and bare-knuckled politics was easily blurred.
The two brothers also shared one more thing: a willingness to use whatever power was available to them.
In William's case, that was a savviness for street-smart politics that propelled him into one of the most powerful positions on Beacon Hill, where he earned a reputation for arm-twisting that rarely saw him lose a battle.
For Whitey, according an inch-thick pile of indictments, that power came at the barrel of a gun and a coterie of enforcers.
Whitey's surprising arrest after 16 years on the run to face 19 murder charges this week has again thrust the brothers' story into the spotlight.
It's a relationship that would dog William Bulger throughout his career, ultimately forcing his resignation as president of the University of Massachusetts system in 2003 after he testified before a congressional committee investigating the FBI's ties to his brother, who by then had been revealed as an FBI informant.
After receiving immunity, William acknowledged receiving a call from Whitey shortly after he fled.
"The tone of it was `Don't believe everything that is being said about me,'" William Bulger said. "I think he asked me to tell everybody he was OK. ... I think I said I hope this has a happy ending."
Two years earlier, William Bulger had told a grand jury he didn't urge his brother to surrender because he didn't "think it would be in his interest to do so," according to a transcript of his testimony obtained by The Boston Globe.
"It's my hope that I'm never helpful to anyone against him," the younger Bulger said, according to the transcript. "I don't feel an obligation to help everyone to catch him."
Among those pressing William Bulger to resign from his university post was then-Republican Gov. Mitt Romney.
For William Bulger it was a role as defender of his brother that he'd long ago accepted, even as Whitey allegedly disappeared into an increasingly violent criminal netherworld.
In his 1996 memoir "While the Music Lasts," William Bulger described Whitey, five years his senior, as being in "a constant state of revolt," and as "restless as a claustrophobic in a dark closet."
Whitey kept himself in top physical shape, neither smoke nor drank, shunned addictive drugs, and had "an abundance of good humor and a wildly creative talent for impish mischief," his brother wrote.
But William Bulger also said Whitey found himself in trouble with police and once ran away to join the circus ? signing on with Ringling Brothers and Barnum & Bailey Circus as a roustabout. The older brother joined the Air Force but had trouble conforming and was later discharged.
"He was just being Jim," Bulger wrote.
William Bulger said that it was around this time that Whitey fell in with a crowd involved in bank holdups and in 1956 was convicted of involvement in three bank robberies and sentenced to 20 years. He served part of what turned out to be an 11-year sentence in Alcatraz.
Four years after Whitey's conviction, William was first elected to the Massachusetts House.
In the years following Whitey's release, William blamed the press for spreading what he called "lurid allegations" about his brother, speculating that some of the "dark rumors" were nothing more than political attacks on him.
As Whitey's criminal activities allegedly turned more brutal, William Bulger rose through the Statehouse ranks. In 1970 he won a Senate seat and eight years later was elected Senate president by the 40-member chamber, a position he would hold for a record 17 years.
Even after Whitey fled in 1995 of the eve of his indictment on racketeering charges, William remained loyal, accusing overzealous prosecutors of buying testimony with promises of early release from prison.
"It has been known for many years that a `get out of jail' card has been available to anyone who would give testimony against my brother," he wrote.
At the same time, William was earning a reputation as a tough-minded leader who rewarded supporters and punished critics.
Warren Tolman, a former Democratic senator who was among those critics, served briefly under him.
Tolman said that although he often found himself at loggerheads with William Bulger, he felt Bulger treated him fairly and could be "a charming guy" when he wanted.
Still, Bulger wasn't shy about using his political might.
Tolman said after he was able to prevent a transportation funding proposal from passing by a single vote, Bulger, who opposed the measure, used his muscle to flip a vote, forcing the proposal through.
"By and large he got his way whenever he wanted," Tolman said. "You knew that if you took him on it was going to be an uphill battle."
Tolman said he never recalled open discussions about Bulger's brother even his Senate colleagues "certainly knew of the legend of Whitey Bulger."
"I don't think anyone ever realized the scope of the dastardly deeds he's accused of," Tolman said.
Occasionally the lines between politics and the underworld blurred.
In 1994, then-state Sen. William Keating led a group of like-minded liberal lawmakers in an attempt to oust Bulger as Senate president.
Although the challenge failed, the campaign against Keating was fierce. Keating said his supporters from South Boston told him that Whitey had paid people to travel to Keating's district to hold signs for his Republican opponent.
Keating said he had his own brief run-in with the reputed mobster, who approached him and lit into him with a barrage of profanity-laced insults for trying to take down his brother.
Keating, who went on to become Norfolk District Attorney before being elected to Congress last year, said he's friends with a family who lost a loved one to Whitey's violence, according to the indictments against him.
"There's a tendency to glamorize abuse of power and a tendency to glamorize the gangster life, but as a district attorney I was there as they were unearthing the bodies of (Whitey Bulger's) victims," Keating said. "It's not funny and it's not glamorous. It was savage and it was brutal."
In a written statement following Whitey's arrest this week, William Bulger said he wished to "express my sympathy to all the families hurt by the calamitous circumstances of this case."
Then, during Whitey's brief appearance in federal court in Boston on Friday, the aging brothers had a fleeting reunion of sorts. Whitey, now 81, smiled at his younger brother and mouthed the word `Hi.' William smiled back.
William, speaking briefly to reporters as he left the courthouse, appeared emotional.
"It's an unusual experience," he said.

BERLIN (AFP) ? Israeli-Argentine conductor Daniel Barenboim will accept a knighthood from the British ambassador to Berlin Thursday for his work toward reconciliation in the Middle East through music, the embassy said.
Barenboim, 68, will become an honorary Knight Commander of the most excellent Order of the British Empire (KBE) but he will not receive a "Sir" title -- an honour reserved for Britons.
British Ambassador Simon McDonald will present the accolade, the highest accorded to foreign citizens, at a gala dinner in the German capital in the name of Queen Elizabeth II.
McDonald hailed Barenboim's tireless campaign for peace between Israel and the Palestinians, including his founding in 1999 of the East-West Divan orchestra with the late Palestinian-American scholar Edward W. Said.
"Daniel Barenboim is a staunch advocate of the unifying power of music. He certainly has become an inspirational figure, not least of all for the next generation of musicians," he said in a statement.
Barenboim, who lives in Berlin and is general music director of the city's State Opera and its Staatskapelle, said he was "deeply touched" by the honour, adding that years he spent in Britain had been "of formative importance until this very day."
Previous recipients of the honorary KBE include former German chancellor Helmut Kohl, US director Steven Spielberg and IT mogul and philanthropist Bill Gates.
